Tennessee’s lead government watchdog, Comptroller Jason Mumpower, is advocating for the appointment of someone impartial to take a closer look at whether Glenn Funk or his team broke any laws.

One of the most troubling aspects highlighted in the report is the culture fostered within Funk’s office, which Mumpower believes threatens public safety. He specifically mentioned concerns about the violation of the Sixth Amendment rights of citizens, emphasizing that the eavesdropping on lawyer-client conversations undermines not just state law but the foundations of the justice system in the United States. “They thought they could violate the rights of citizens, where they listen in or eavesdrop or wiretap what are sacred conversations,” he lamented.

When asked if these unethical practices could result in criminal defendants escaping punishment, Mumpower responded carefully, “I can’t say that anybody is going to walk free. But it’s not a stretch for anyone to think that any defense attorney who has spent any amount of time in that particular interview room is going to be racing to the courthouse to file for reconsideration on behalf of a client they represented.”

A spokesperson for the DA stated, “This matter is now at an end.” However, Mumpower’s perspective stands in stark contrast, as he suggested that Funk should consider recusing himself to allow an independent evaluation of the evidence.
Mumpower concluded, “If he feels that strongly—then there is absolutely no harm in recusing himself… to determine if a prosecution is warranted.”
