Tennessee’s lead government watchdog, Comptroller Jason Mumpower, is advocating for the appointment of someone impartial to take a closer look at whether Glenn Funk or his team broke any laws.

The investigative report, released recently, detailed alarming findings, including the shocking revelation that Funk’s office was covertly recording defense attorneys without their knowledge. The recordings were made during sensitive moments when defense attorneys reviewed evidence in the DA’s suite. As Mumpower pointed out, “When you look at this report, when you look at what has happened in the District Attorney General’s Office, you know, you don’t even need to watch a full episode of ‘Law and Order’ to know that it was wrong.”

Culture of Eavesdropping

One of the most troubling aspects highlighted in the report is the culture fostered within Funk’s office, which Mumpower believes threatens public safety. He specifically mentioned concerns about the violation of the Sixth Amendment rights of citizens, emphasizing that the eavesdropping on lawyer-client conversations undermines not just state law but the foundations of the justice system in the United States. “They thought they could violate the rights of citizens, where they listen in or eavesdrop or wiretap what are sacred conversations,” he lamented.

Previous Investigations and Gossip

The fallout from these revelations traces back to a raid by the Tennessee Bureau of Investigation (TBI) that occurred in March 2023. This raid stemmed from inquiries about security cameras that had microphones, causing alarm over the extent of surveillance in the DA’s office. It appears that defense attorneys were not the only individuals being monitored—various conversations in and around Funk’s office were also captured without consent.

When asked if these unethical practices could result in criminal defendants escaping punishment, Mumpower responded carefully, “I can’t say that anybody is going to walk free. But it’s not a stretch for anyone to think that any defense attorney who has spent any amount of time in that particular interview room is going to be racing to the courthouse to file for reconsideration on behalf of a client they represented.”

Calls for Action

In the wake of the report, Nashville Public Defender Martesha Johnson Moore called out Funk, asserting that the allegations point to a “systemic abuse of prosecutorial discretion.” Moore declared that her office would be demanding Funk disclose all cases—both ongoing and resolved—that were affected by the questionable surveillance practices.

Adding to the list of worries, the report aligns with findings from earlier investigations into Funk’s office, including evidence suggesting campaign work was conducted on government time. These past revelations have added fuel to a fire that many fear could jeopardize fair trial rights for accused individuals.

Inevitability of Recusal?

Despite the gravity of Mumpower’s findings, Tennessee Attorney General Jonathan Skrmetti has stated that he doesn’t believe there’s enough evidence to prosecute Funk. Funk’s office, claiming victory, insists he and his staff have done nothing wrong. A spokesperson for the DA stated, “This matter is now at an end.” However, Mumpower’s perspective stands in stark contrast, as he suggested that Funk should consider recusing himself to allow an independent evaluation of the evidence.

Mumpower concluded, “If he feels that strongly—then there is absolutely no harm in recusing himself… to determine if a prosecution is warranted.”
